Welcome to X4T Debit Card Services

Introduction

Thank you for choosing the X4T Debit Card. Before you start using your new card, it’s important that we outline and explain the Terms of Service that will guide your usage of the card. This document serves as a legal agreement between you (the cardholder) and X4T, establishing the rules and requirements for using our debit card services.


Agreement to Terms

By ordering your X4T Debit Card, and checking the box marked “I have read and understand the Terms and Conditions/Terms of Service” on our order form, you acknowledge that you have reviewed these terms in full. You also agree to comply with these terms as long as you continue to use our debit card. It is essential that you read this agreement carefully. If you do not agree with any part of these terms, please do not proceed with ordering the card.


Purpose of the Debit Card

The X4T Debit Card is designed to provide you with easy access to your X4T assets. You can use it for purchases at merchants, online transactions, and ATM withdrawals anywhere that accepts our card. This card aims to offer a secure and convenient way to manage and spend your funds.


Changes to Terms of Service

We may update these terms occasionally to reflect changes to our service, legal requirements, or operational adjustments. If any significant changes are made, we will notify you through email or a prominent notice on our website. Continued use of your debit card after these changes will constitute your acceptance of the revised terms.


Registration and Account Management


Creating Your Account

To apply for an X4T Debit Card, you must first create and register an account with us. The registration process will require you to provide accurate and current personal information, which may include your name, address, email, phone number, and other relevant details. You may also be required to verify your identity to comply with regulatory requirements. This could involve uploading government-issued identification documents. 


Managing Your Account

Once your account is established, you will manage your funds and your debit card through your X4T account dashboard. It is your responsibility to ensure that all information in your account remains accurate and up-to-date. If any information changes, please update your account details promptly to avoid any service disruptions.


Security of Your Account

You are responsible for maintaining the confidentiality of your account information, including your password. We recommend using a strong, unique password for your X4T account to help ensure the security of your account and to activate 2FA. If you suspect any unauthorized use of your account or any other security breach, please inform us immediately. X4T will not be liable for any loss or damage arising from your failure to comply with this security obligation.


Privacy and Data Protection

We take the privacy and security of your personal data seriously. All personal information you provide during the registration and verification process is protected in accordance with our Privacy Policy. We do not share your personal data with third parties without your explicit consent, except as necessary to process transactions or comply with legal obligations.


Funding the Card


Funding Mechanism

The X4T Debit Card must be funded directly from your X4T Wallet. Funds transferred from the X4T Wallet to the Debit Card will be subject to the following conditions:


Source of Funds: Only funds held within your X4T Wallet are eligible for transfer to the X4T Debit Card. Transfers must be initiated by the cardholder through the X4T account interface.
Transaction Limits: The amount transferred from the X4T Wallet to the X4T Debit Card shall adhere to predefined transaction limits, which are detailed in a separate document accessible through your account dashboard. These limits are imposed to comply with regulatory requirements and to ensure the security of transactions.
Transfer Confirmation: All transfers require electronic confirmation by the cardholder. Once a transfer is confirmed, it is considered final and irrevocable. X4T is not responsible for errors in transfer amounts entered by the cardholder.


Availability of Funds

Funds transferred to the X4T Debit Card will be credited to the card balance and will be available for use in accordance with the processing schedules established by X4T. X4T shall not be liable for any delays in the availability of funds or any losses incurred as a result of such delays.


Compliance

Cardholders agree to comply with all applicable laws and regulations in relation to the funding of the X4T Debit Card. The cardholder is solely responsible for ensuring that the transfer of funds complies with applicable laws, including but not limited to anti-money laundering and anti-terrorism financing laws.


Usage Guidelines

Use of the X4T Debit Card is subject to the following guidelines, which are designed to ensure compliance with relevant laws and the terms of our partners, Visa and its respective network account manager.

General Use: The X4T Debit Card can be used at any merchant or ATM that accepts Visa cards. Cardholders are expected to use the card in a responsible manner and in accordance with the card acceptance guidelines provided by Visa.


Prohibited Uses:


The following uses of the X4T Debit Card are explicitly prohibited:

Illegal Transactions: The card may not be used for any illegal purposes, including but not limited to illegal online gambling, drug trafficking, or money laundering.
Violation of Sanctions: The card must not be used in a manner that would violate any economic sanctions or trade embargoes administered or enforced by the applicable regulatory authorities in the cardholder’s jurisdiction or any other relevant jurisdiction.


Compliance with Zypto and Visa Terms:

The use of the X4T Debit Card is also subject to the terms and conditions set forth by Zypto and Visa. It is the cardholder’s responsibility to be familiar with and adhere to these terms. In the event of a discrepancy between X4T’s Terms of Service and those of Zypto or Visa, the more restrictive terms shall apply to ensure compliance with all regulatory requirements.


Monitoring and Enforcement:

X4T reserves the right to monitor transactions for compliance with these guidelines. Actions that are identified as violating the Usage Guidelines may result in the suspension or termination of card privileges and, if applicable, legal action.


Fees and Charges

By using the X4T Debit Card, you acknowledge and agree to the applicable fees and charges as outlined in the Fees and Charges document provided during the registration process and available for review in your account dashboard. These fees may include, but are not limited to, annual fees, transaction fees, and charges for special services.


Notification of Changes:

X4T reserves the right to modify these fees and charges at any time. Changes will be communicated to you at least 7 days before they become effective. Notifications of changes will be sent to the email address associated with your account and will also be available in your account dashboard.


Acceptance of Fees:

Your continued use of the X4T Debit Card after any changes to the fees have been implemented constitutes your agreement to such changes. If you do not agree with the changes, you have the right to terminate your card account prior to the changes taking effect.


Privacy and Personal Data

At X4T, we are committed to maintaining the trust and confidence of our customers. Protecting your personal and financial information is one of our highest priorities. The following terms outline our practices regarding the collection, use, and protection of your personal information:


Collection of Information:

X4T collects personal information necessary to provide you with the debit card services. This information includes, but is not limited to, your name, address, email address, phone number, and financial data. Collection occurs at the time of account registration and during your subsequent use of the debit card.


Use of Information:

Your personal information is used to manage your account, process transactions, respond to inquiries, and enhance your overall service experience. We may also use this information to comply with legal and regulatory requirements.


Protection of Information:

We implement a variety of security measures to maintain the safety of your personal information. These include encryption, firewalls, and access controls. We are dedicated to securing your data from unauthorized access, alteration, disclosure, or destruction.


Sharing of Information:

X4T does not sell, trade, or rent your personal information to third parties. Your information may be shared with trusted partners who assist in conducting financial operations, such as card processing, under strict confidentiality agreements. These partners are prohibited from using your personal information for any other purpose.


Retention of Information:

We retain your personal information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, please contact us directly.


Changes to Privacy Policy:

Our Privacy Policy may change from time to time. We will post any privacy policy changes on our website and, where appropriate, notify you by email. It is advisable to review this policy periodically for any changes.


Limitations of Liability


Scope of Liability:

X4T and its affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the debit card. This limitation of liability applies to damages of any kind, including but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing. We are not liable for any failures, disruptions, or errors in the operation of the debit card that are beyond our control, including those that result from the use of third-party services, hardware, or software.


Risk Acknowledgement:

By using the X4T Debit Card, you acknowledge that there are risks associated with using a digital asset-based debit card. These risks include, but are not limited to, changes in cryptocurrency market conditions, regulatory changes, and potential technical failures. You agree that X4T is not responsible for any financial losses related to these risks.


Dispute Resolution

Should any concerns or disputes arise regarding your use of the X4T Debit Card, please direct all correspondence to our support team via email at [[email protected]](/cdn-cgi/l/email-protection). We are dedicated to a prompt review and resolution of all inquiries.


Resolution Process:

In the event of a dispute, the following process shall apply: Upon receipt of your communication, our team will engage with you to understand and address your concerns. Should we be unable to resolve the dispute through direct discussion, you may be invited to participate in confidential binding arbitration. Arbitration shall be conducted by an independent and neutral arbitrator in accordance with applicable arbitration laws. Specifics of the arbitration process, including the selection of an arbitrator, rules of procedure, and cost allocation, will be provided to you at that time. This arbitration process shall be the exclusive means of resolving any dispute that arises out of the use of your X4T Debit Card, except as otherwise agreed by both parties in writing.


Governing Law:

This Dispute Resolution process will be governed by and construed in accordance with the laws of the jurisdiction in which the company is registered, without giving effect to any principles of conflicts of law.

Termination and Suspension


Conditions:

X4T reserves the right to suspend or terminate your debit card and associated account under certain conditions. These conditions include, but are not limited to, non-compliance with the Terms of Service, violation of any laws or regulations, fraudulent activities, or actions that may cause harm to X4T, its users, or its affiliates. Additionally, any breach of the terms and conditions set forth by our partners, including Visa, may result in immediate suspension or termination of your card privileges.


Reinstatement:

If your account is suspended or terminated, you may contest this decision by contacting X4T at [[email protected]](/cdn-cgi/l/email-protection). The process for reinstatement will involve a review of the circumstances leading to the suspension or termination. During this review, you will have the opportunity to present any relevant information or evidence that may support your case for reinstatement. Based on the findings of the review, X4T will decide whether to lift the suspension or reinstate your account. This decision is final and will be communicated to you through the contact information associated with your account.


Amendments to the Terms

X4T reserves the right to modify, amend, or change the Terms of Service at any time without prior notice. Such amendments may be necessary due to the evolution of technologies, changes in the law, or adjustments in our business model. When changes are made, X4T will update the Terms of Service on our website and provide a notice of these changes at the top of the Terms of Service page. Additionally, an email notification will be sent to all users at the email address provided in their account settings.

It is your responsibility to review the Terms of Service periodically to stay informed of any changes. The date of the last modification will always be posted at the beginning of the Terms of Service document. Continued use of the X4T Debit Card and associated services after any such changes shall constitute your consent to such changes.


Governing Law

The Terms of Service shall be governed by and construed in accordance with the laws of Paraguay, without regard to its conflict of law principles. Any disputes arising out of or related to the Terms of Service or the use of the X4T Debit Card shall be subject to the exclusive jurisdiction of the courts located in Paraguay. By using the X4T Debit Card, you consent to the jurisdiction and venue of such courts and waive any objection as to inconvenient forum.


Miscellaneous


Intellectual Property Rights:

All intellectual property rights related to the X4T Debit Card, the X4T website, and all associated services are owned by X4T or its licensors. The use of our services does not grant you any rights to our intellectual property, including the software, logos, trademarks, graphics, or any related documentation. You are granted a non-exclusive, non-transferable, revocable license to access and use the X4T website and services strictly in accordance with these Terms of Service.


Affiliation Disclosures:

X4T may be affiliated with other entities that contribute to the provisioning of the debit card services. These affiliations may influence the products and services offered but do not relieve X4T of its obligations under these Terms of Service. Details of these affiliations are disclosed as required by law and when deemed necessary by X4T for transparency with its users.


Compliance Obligations:

X4T complies with all applicable laws, regulations, and standards in providing the debit card services. Users are also expected to comply with all applicable laws related to their use of the debit card. Failure to comply with these laws may result in termination of your account and access to our services.


Severability:

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.


Entire Agreement:

These Terms of Service constitute the entire agreement between you and X4T regarding the use of the X4T Debit Card and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and X4T.


No Waiver:

The failure of X4T to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.


Precedence of the Terms:

In the event of any inconsistency or conflicting provisions between these Terms of Service and any other terms, guidelines or policies relating to the X4T Debit Card, the terms of X4T.com shall prevail. The Terms of Service constitute the sole and entire agreement between the User and X4T with respect to the use of the X4T Debit Card and supersede all prior understandings, agreements, representations and warranties, both written and oral, with respect to such use.
